Upon roll call, the following council members were present: James Gartner, Shane Jahnner, Randall Meidinger, Wayne Ehley, Travis Dockter, Eric Schmidt. Also in attendance were City Administrator/Auditor Sharon Jangula, Public Works Director Tyler Gross.</p>
<p>The Pledge of Allegiance was recited.</p>
<p>A motion to approve the August 3, 2026 Regular Meeting Minutes was made by James Gartner, second by Shane Jahner. Unanimous aye vote; motion carried.</p>
<p>Public Comments / Visitors:<br />
Rory Humann addressed the council regarding garbage pickup. He said the garbage should be picked up street-side year-round rather than switching to alley pickup in the Spring.  He also expressed concern about the use of golf carts around town, especially those being driven by kids.</p>
<p>Mayor Jacob informed him that both issues are being addressed.</p>
<p>Vickie Martin addressed the council saying the garbage should be picked up either street-side or in the alley, but should not be switched back and forth.  </p>
<p>Greg Langeliers addressed the council requesting to purchase Lot 3, Block 4, Original Town. He said he owns the adjoining lots to the north.  He also asked if he could obtain an easement to Lot 4 for driveway and utility access.  There was discussion that Lot 4 is deed restricted and, therefore he may not be able to obtain an easement.  After further discussion, a motion to approve selling Lot 3 for the costs of the 24-1 Special Assessment and closing costs was made by Wayne Ehley, second by Randall Meidinger.  Unanimous aye vote; motion carried.</p>
<p>Donavin Grenz addressed the council requesting help and assistance to obtain a permit for construction in the floodway.  He said he is working with a surveyor/engineer from Mandan.  Mr. Grenz was told that he will need to provide the documentation required by FEMA, and the city must get approval from the State before construction can be approved.</p>
<p>Marcy Sanders, KEM Electric Cooperative, addressed the council regarding KEM Electric’s Franchise Agreement which needs to be renewed. A motion to approve the First Reading of Ordinance 2026-09-01 Granting to KEM Electric Cooperative, Inc a Franchise and Right to Construct, Maintain and Operate was made by Randall Meidinger, second by Shane Jahner. Unanimous aye vote; motion carried.</p>
<p>A motion to approve an On-Sale Beer License for Shirl’s Country Diner and Treasures was made by James Gartner, second by Eric Schmidt. Unanimous ay vote; motion carried.</p>
<p>A motion to approve Building Permit Applications 26-36 MDU building demolition; 26-37 Jacques Van Leeuwen cement work; 26-38 Anton Baumgartner cement work; 26-39 Liz &#038; Justin Jochim replace garage siding, cement work; 26-40 Keith’s Service &#038; Repair cement work; 26-42 Mark Lawler house demolition; 26-43 Shirley Goldade install business sign; 26-44 Debbi Lindeman add carport was made by Wayne Ehley, second by James Gartner. Unanimous ay vote; motion carried. </p>
<p>A motion to table Building Permit Application 26-41 Donavin Grenz complete construction of building was made by James Gartneer, second by Eric Schmidt.  Unanimous aye vote, motion carried. </p>

<p>Discussion was held on the park built at the intersection of Schley Avenue and 6th St. A motion to accept the conveyance from Shawna Paul of the West Four Feet (W 4′) of Lot Five (5) and all of Lot Six (6), Block One (1), Original Town of Linton City, for use as Mike Paul Memorial Park, and to authorize the Mayor and City Auditor to take any actions necessary to complete the transfer was made by James Gartner, second by Shane Jahner. Unanimous aye vote; motion carried.</p>
<p>Mayor Jacob asked if there were any other items needing to be addressed or comments from the public at this time.</p>
<p>Rory Humann asked the council if they could check into a vehicle that is partially blocking the view of oncoming traffic at an intersection. He was told the matter would be addressed.</p>
<p>Vickie Martin expressed concern regarding safety and privacy for children while in the parks. Discussion was held on her concern with no formal action taken.<br />
The council held other discussion on parking of oversized trailers on the street for extended times, sidewalks, overgrowth of trees and progress of cleanups.</p>
<p>Tyler Gross informed the council that a portion of the sewer main near the intersection of Sampson Ave &#038; 2nd St. SE will need to be relined at an estimated cost of $25,000.  He said the Mayor and Sewer Committee were aware of the existing problem and the work is scheduled for later this month. </p>
<p>The next City Council meeting will be held on Monday, October 5, 2026 at 5:00 pm with a Public Hearing on the 2027 Budget held at 5:30 pm. Fall Cleanup Days will be September 21st and 22nd.</p>

<p>A motion to approve the July 6, 2026 Regular Meeting Minutes was made by James Gartner, second by Shane Jahner. Unanimous aye vote; motion carried.</p>
<p>AJ Tuck, Moore Engineering gave an update on the 24-1 Street Project. He presented Bituminous Paving Change Order No. 4 in the amount of -$284,726.80.  Mr. Tuck said the final contract amount for Bituminous Paving is $2,842,573.49. A motion to approve Change Order No. 4 was made by Wayne Ehley, second by Eric Schmidt.  Unanimous aye vote; motion carried.</p>
<p>A motion to approve Bituminous Pay Application 7 in the amount of $41,155.00 was made by James Gartner, second by Eric Schmidt. Unanimous aye vote; motion carried.</p>
<p>A motion to approve Moore Engineering Invoice SIN010809 in the amount of $6,264.63 was made by Randall Meidinger, second by Travis Dockter. Unanimous aye vote; motion carried.</p>
<p>Mayor Jacob said that he, Council Members Meidinger and Jahner, and Public Works Director Gross did a final inspection of the project with Mr. Tuck. He said overall the project turned out well and the streets look good.  </p>
<p>AJ Tuck also reported the storm sewer pipe relining from 1st St. SE to Broadway St. South was just completed.  He said he reviewed the video footage and everything appears to be good.  The invoice from CC Steel to reline the storm sewer is $190,251.00.  Mr. Tuck said the city had previously been approved for a cost share of up to $99,000.00 from the Department of Water Resources leaving the city’s cost at $91,251.00.  </p>
<p>A motion to approve payment to CC Steel in the amount of $190,251.00 was made by James Gartner, second by Shane Jahner.  Unanimous aye vote; motion carried.  At the May 5, 2025 meeting, the city council had approved paying the city share of the costs with Municipal Infrastructure funds.</p>
<p>Public Comments / Visitors:<br />
Jerald Roehrich addressed the council regarding a problem with feral cats.  Mayor Jacob said the issue has been addressed with the renter and owner of the property.</p>
<p>There were no other public comments or visitors wishing to address the council at this time.</p>

<p>The public was asked if there were any other comments or discussion they would like addressed.  There was none.</p>
<p>Discussion was held on security cameras with the matter being tabled.  Discussion was held on the use of portable carports as permanent storage of vehicles.  There was general consensus this is not allowed by ordinance. </p>
<p>An estimate from Lots and Lines for painting of streets and fire hydrants was reviewed.  After discussion, a motion to approve moving forward with the painting was made by James Gartner, second by Eric Schmidt.  Unanimous aye vote; motion carried.  The cost of the painting is estimated to be $13,200.00.</p>
<p>Discussion was held on the condition of the west sidewalk at the Civic Center.  A motion to approve repairing the sidewalk at an estimated cost of $1,300.00 was made by James Gartner, second by Shane Jahner. Unanimous aye vote; motion carried.<br />
A motion to accept a WSI grant of up to $10,000 to replace two office chairs and purchase a broom attachment or man-hole lift tool was made by Shane Jahner, second by Eric Schmidt. Unanimous aye vote; motion carried.</p>
<p>The Preliminary Budget was reviewed. The budget included $100,000 for law enforcement and set an overall increase in wages of 3.65% with the increase being split equally among the full-time employees.  The estimated property tax levy amount for all city funds including the library and airport is $231,864.00; an increase of $6,937.00 over last year. </p>
<p>A motion to approve the 2027 Preliminary Budget and set October 5, 2026 at 5:30 pm in the Community Center for a Public Hearing on the Budget was made by James Gartner, second by Randall Meidinger.  Unanimous aye vote; motion carried.</p>
<p>The next City Council meeting will be held on Monday, September 8, 2026 at 5:00 pm.  </p>

									</div></div><p>The meeting was called to order by Mayor Daniel Imdieke on Monday, July 6, 2026 at 5:00 pm. Upon roll call, the following council members were present: James Gartner, Brian Jacob, Randall Meidinger, Wayne Ehley, Travis Dockter, Eric Schmidt, Newly Elected Shane Jahner. Also in attendance were City Attorney Joseph Hanson, Public Works Director Tyler Gross, City Administrator/Auditor Sharon Jangula.</p>
<p>The Pledge of Allegiance was recited.</p>
<p>A motion to approve the June 1, 2026 Regular Meeting Minutes and the June 15, 2026 Special Meeting Minutes was made by Wayne Ehley, seconded by Eric Schmidt. Unanimous aye vote; motion carried.</p>
<p>The Official Results of the June 9, 2026 City of Linton Election were reviewed.  A motion to accept the Election Results was made by James Gartner and seconded by Eric Schmidt. Unanimous aye vote; motion carried.   Results: Mayor – Brian Jacob; Council Member Ward I &#8211; James Gartner; Council Member Ward II &#8211; Wayne Ehley; Council Member Ward III – Shane Jahner; Park Board Members – Tyler Gross, Heather Hase, Shannon Schirado.</p>
<p>Mayor Imdieke passed the gavel to newly elected Mayor Brian Jacob. Mayor Jacob thanked Mayor Imdieke for his years of service to the city.</p>
<p>At this time, Mayor Jacob opened the Public Hearing on the Issuance of Education Facilities Revenue Bonds for the University of Mary Project.</p>
<p>Paul Keeney, University of Mary, addressed the council explaining what the bonds will be used for.  </p>
<p>Kevin Dykema, Bravera Bank, addressed the council regarding the procedures for issuance of the bonds.  </p>
<p>A bond resolution was reviewed by the council with Mr. Keeney and Mr. Dykema answering questions.</p>
<p>Discussion was held on the issuance, including using Scott Wegner as bond counsel. It was noted during discussion that the city will not be responsible for repaying the bonds; the city will receive payment of $1,000 per million of issuance; Mr. Wegner has served as bond counsel for other projects in the city. </p>
<p>Mayor Jacob asked if anyone present had any questions or comments regarding the bond issuance.  There were no questions or comments.</p>
<p>A motion to approve the Bond Resolution for Education Facilities Revenue Bonds (University of Mary Project) in the amount of $10,000,000 and request Scott Wegner serve as bond counsel was made by James Gartner, and seconded by Randall Meidinger. Unanimous aye vote. Motion carried.</p>
<p>AJ Tuck, Moore Engineering addressed the council via video conference with an update on the 24-1 Street Project. He explained Change Order 3 in the amount of -$82,258.70. A motion to approve Changer Order 3 was made by Wayne Ehley and seconded by Travis Dockter. Unanimous aye vote; motion carried.</p>
<p>Mr. Moore explained Bituminous Paving Pay Application 6 in the amount of $830,763.70.  A motion to approve payment of Pay Application 6 was made by James Gartner and seconded by Eric Schmidt. Unanimous Aye Vote; motion carried</p>
<p>Public Comments / Visitors:<br />
Rory Human addressed the council regarding the chip seal project. He expressed concern about the tar still being wet and ridges on the street.  Mr Tuck addressed his concerns and explained the tar will dry with more time and the ridges are common where there is an overlap in the chip seal.</p>
<p>The council reviewed Moore Engineering invoice SIN010155 in the amount of $31,121.41. A motion to approve payment of the invoice was made by Randall Meidginer and seconded by Eric Schmidt. Unanimous aye vote; motion carried.</p>
<p>There were no other public comments or visitors wishing to address the council at this time.</p>
<p>A motion to approve Building Permit Applications 26-23, 26-24, 26-25, 26-26, 26-27, 26-28, 26-31, Amended 26-04, 26-30 contingent on meeting floodplain requirements and to deny 26-29 was made by Randall Meidinger and seconded by James Gartner.  Motion carried 5-0-1 with Wayne Ehley abstaining. Permits: 26-23 David Flegel concrete work; 26-24 Jacques Van Leeuwen replace deck; 26-25 Linton Park Board construction of pickleball court and shelter; 25-26 Richard Goldade detached garage; 25-27 Jarrod Federicks change siding, soffit and roofing; Ryan Baumgartner replace bathtub; 26-29 Kevin Evanson turn carport into garage; 26-30 Mylo Kramer replace driveway; 26-31 Chris Lankford install egress window; 26-04 increase length of building and change door size.</p>
<p>A motion to approve Gaming Permit Applications was made by Wayne Ehley and seconded by Travis Dockter. Unanimous aye vote; motion carried. Gaming Permit Application: 26-8 American Legion Dan R. Richardson Post #54-raffle 08/31/26.</p>
<p>A motion to approve Special Event Permits allowing the sale of alcoholic beverages was made by Wayne Ehley, seconded by James Gartner. Unanimous aye vote; motion carried. Special Event Permits: Happy Hour at Linton Civic Center for wedding receptions on 8/1/26, 8/8/26, 8/15/26, 8/22/26.</p>
<p>A motion to approve the Second Reading of Ordinance 2026-05-01 An Ordinance Regulating the Use and Maintenance of Boulevards and Rights-Of-Way, Prohibiting Certain Encroachments and Activities, and Providing Penalties for Violations was made by Gartner, seconded by Eric Schmidt. Unanimous aye vote; motion carried. There was discussion that existing boulevards are grand-fathered in.  However, no additional rock can be added or rock replaced.</p>
<p>A motion to approve the June 2026 Monthly Financial Report was made by Travis Dockter and seconded by Eric Schmidt.  Unanimous aye vote; motion carried.</p>

<p>A motion to approve Gaming Site Authorizations for the Linton Lions Club from July 1, 2026 to June 30, 2027 at Country Climate, Green Lantern and Happy Hour was made by Randall Meidinger and seconded by James Gartner. Unanimous aye vote; motion carried</p>

Upon roll call, the following council members were present: James Gartner, Brian Jacob, Randall Meidinger, Wayne Ehley, Travis Dockter, Eric Schmidt. Also in attendance were City Attorney Joseph Hanson and City Administrator/Auditor Sharon Jangula.</p>
<p>The Pledge of Allegiance was recited.</p>
<p>The purpose of the meeting was to discuss the construction of a new building taking place in the regulatory floodway without an approved permit to build. </p>
<p>Donavin Grenz addressed the council regarding the construction of the building.  Mr. Grenz said he did not intend to stop the construction. </p>
<p>Attorney Hanson informed the council that a Stop Work Order and Notice of Violation was issued to Mr. Grenz earlier in the day.</p>
<p>During discussion it was noted that Mr. Grenz had submitted a building permit for the construction, but the permit was denied because Mr. Grenz did not submit the no-rise certification which is required by FEMA and the City of Linton Flood Plain Management Ordinance. Mr. Grenz had been informed previously he would need to submit the no-rise certification before construction could be approved.</p>
<p>A motion to file an injunction against Mr. Grenz to stop construction was made by Randall Meidinger, seconded by James Gartner. Unanimous aye vote; motion carried.</p>
<p>A motion to adjourn was made by Brian Jacob.  Meeting adjourned.</p>

<p>Visitors/Public Comments:<br />
Paul Keeney, University of Mary, and Kevin Dykema, Bravera Bank, addressed the council regarding the city’s ability to issue Bank Qualified (BQ) Tax-Exempt Bonds. The city can issue up to $10 million in BQ bonds in a year and can designate the intended use for the bonds. Banks purchasing the bonds can offer a lower interest rate to the borrower. </p>
<p>Mr. Keeney requested the city issue BQ bonds to assist in financing capital improvements at the University of Mary. When issuing the bonds, the city does not guarantee the debt and is in no way responsible for repayment of the bonds.  The city will incur no expense for the issuance and will be paid $1,000 per million of bond issuance.  </p>
<p>Discussion was then held on the bond issuance and the amount.  A motion to approve moving forward with the process of issuing $10 million in BQ bonds to be used in financing the projects at the University of Mary was made by Randall Meidinger, seconded by James Gartner. Voting aye; Gartner, Meidinger, Dockter, Schmidt. Voting nay: Ehley.  Motion carried 5-1.</p>
<p> The next step in the process is a public hearing on the issuance of the bonds.</p>
<p>AJ Tuck, Moore Engineering addressed the council via video conference with an update on the 24-1 Street Project. He explained the contractors are switching from doing a scrub seal to a chip seal.</p>
<p>A motion to approve Building Permit Applications 26-12, 26-13, 26-14, 26-15, 26-17, 26-18, 26-19, 26-20, 26-21, 26-22 and 26-16 contingent on the Mayor’s approval after addressing concerns expressed by an adjoining property owner. Unanimous aye vote; motion carried. Building Permit Applications: 26-12 Marlin Sapp -build detached garage; 26-13 White Drug Pharmacy – remodel interior of building; 26-14 Shelley Hauge – landscaping; 26-15 Linton Dental Center – adding dental operatories; 26-16 Burgad Cabins, LLC – replace windows and door, build detached garage; 26-17 Melinda Baumgartner – replace windows; 26-18 Karlee Benth – remodel house; 26-19 Corrina Ford – install fence; 26-20 United Methodist Church – replace sidewalk and waterline; 26-21 Nicolas Kramer – replace front steps and cement pad; 26-22 Tyler Gross – add deck with roof extension. </p>
<p>A motion to approve Gaming Permit Applications was made by Travis Dockter, seconded by Eric Schmidt. Unanimous aye vote; motion carried. Gaming Permit Application: 26-7 American Legion Dan R. Richardson Post #54-raffle 07/31/26.</p>
<p>A motion to approve Special Event Permits allowing the sale of alcoholic beverages was made by James Gartner, seconded by Wayne Ehley. Unanimous aye vote; motion carried. Special Event Permits: Phat Shack, LLC to sidewalk/boulevard located at 102 Broadway St. S for Ag Day on June 12, 2026; Happy Hour Bar to McCrory Parking Lot/Street for Ag Day on June 12, 2026; Happy Hour at the Linton Civic Center for a Reunion on July 17 &#038; 18, 2026; and a Wedding Reception on July 25, 2026.</p>
<p>A motion to approve Resolution for Emmons County Emergency Management was made by Travis Dockter, seconded by Wayne Ehley.  Unanimous aye vote; motion carried.</p>
<p>A motion to approve the First Reading of Ordinance 2026-05-01 An Ordinance Regulating the Use and Maintenance of Boulevards and Rights-Of-Way, Prohibiting Certain Encroachments and Activities, and Providing Penalties for Violations was made by Gartner, seconded by Eric Schmidt. Unanimous aye vote; motion carried.</p>

<p>The council reviewed and discussed the recommendations made by the Water &#038; Sewer Committee Members James Gartner and Randall Meidinger. A motion to approve the recommendations was made by James Gartner, seconded by Eric Schmidt. Unanimous aye vote; motion carried. Recommendations: no charges for water &#038; sewer on lots without a structure; no water &#038; sewer charges for lots with a garage that does not have water &#038; sewer connections; vacant houses or houses used for storage will pay water &#038; sewer fees; $500.00 connection fee to city water & sewer; property owners can continue to pay the monthly water &#038; sewer fee for vacant lots instead of paying a connection fee in the future; decrease the street light fees by $1.00 per month and increase the sewer fees by $1.00 per month; new rates effective July 1, 2026.</p>
<p>A motion to approve selling Parcel 52-0001-00123-00 located at 713 Schley Ave. W for the cost of the 24-1 Special Assessments and the closing costs to James Gartner was made by Brian Jacob, seconded by Eric Schmidt. Voting aye: Jacob, Medinger, Ehley, Dockter, Schmidt. Abstaining: James Gartner. Motion carried 5-0-1.</p>
<p>A motion to approve selling Parcels 52-0016-00836-000 and 52-0016-00837-000 located at 501 Elm Ave. E for the cost of the 24-1 Special Assessments and the closing costs to Richard Weigelt and Jason Weigelt was made by James Gartner, seconded by Brian Jacob.  Unanimous aye vote; motion carried.</p>
<p>Jangula informed the council the mayor had approved a Special Event Permit to Happy Hour Bar for the American Legion Memorial Day Supper at the Emmons County Courthouse on May 25, 2026. She said the mayor had also approved adding raffles to the Linton Lions Gaming Site Authorization at the Happy Hour Bar.  The requests had been submitted to the city after the last meeting and prior to the functions.</p>
<p>Other discussion was held on properties that do not comply with notices to “clean up” the property.</p>
<p>The city elections will be on June 9, 2026.</p>
<p>The next City Council meeting will be held on Monday, July 6, 2026 at 5:00 pm.  </p>

<p>A motion to approve the April 6, 2026 Regular Meeting Minutes and the April 7, 2026 Tax Equalization Meeting minutes was made by Brian Jacob, seconded by James Gartner. Unanimous aye vote; motion carried.</p>
<p>Visitors/Public Comments:<br />
Don Wilhlem addressed the council regarding three properties which he said are a safety hazard to the public and the city needs to do something to address it. </p>
<p>Mr. Wilhelm also addressed the council regarding a nursing home. He said with the hospital, clinic and assisted living, the synergies are in place to add a nursing home in Linton.</p>
<p>Lillian Dahms addressed the council expressing concerns about creating parking restrictions in private yards.</p>
<p>A motion to approve Building Permit Applications 26-09, 26-10, 26-11 was made by Randall Meidinger, seconded by Travs Dockter. Unanimous aye vote; motion carried. Building Permit Applications: 26-09 Craig Weber-replace shower; 26-10 Tim Ibach-remodel kitchen; 26-11 United Methodist Church-remodel parsonage. </p>
<p>A motion to approve Gaming Permit Applications was made by Brian Jacob, seconded by Wayne Ehley. Unanimous aye vote; motion carried. Gaming Permit Application: 26-6 American Legion Dan R. Richardson Post #54-raffle 06/30/26.</p>

<p>A motion to approve the second reading and adoption of 2026-04-01 An Ordinance Establishing Minimum Utility Standards for Residential Dwellings and Enforcement Procedures, Providing Penalties for the Violation Thereof was made by Brian Jacob, seconded by James Gartner. Unanimous aye vote; motion carried.</p>
<p>After discussion, it was determined to table the second reading of 2026-04-02 An Ordinance to Prevent the Unlawful Storage of Certain Vehicles, Boats, or Other Equipment, and to Provide Penalties for Such Unlawful Storage.<br />
A motion to approve the second reading and adoption of 2026-04-03 An Ordinance Prohibiting the Unauthorized Removal of Refuse from City-owned Solid Waste Facilities, and Providing Penalties for the Violation Thereof was made by James Gartner, seconded by Wayne Ehley. Unanimous aye vote; motion carried.</p>

<p>Discussion was held on purchasing or leasing a new wheel loader.  Three quotes were received for the loader.  After further discussion, a motion to lease the JD 544P Wheel Loader was made by James Gartner, seconded by Travis Dockter.  Voting aye-James Gartner, Wayne Ehley, Travis Dockter; voting nay-Brian Jacob, Randall Meidinger.  Motion carried 3-2.</p>
<p>Sharon Jangula reported that Liliam Dahms is interested in obtaining ownership of Parcel 52-0011-00711-000. The parcel is 50&#8242; x 50&#8242; with a dilapidated house on it.  Ms. Dahms, who owns the adjoining property, will have the house torn down and assume the remaining 24-1 special assessments on the property.  A motion to deed the property to Lillian Dahms was made by James Gartner, seconded by Brian Jacob. Unanimous aye vote; motion carried.</p>
