APPROVED JULY 11, 2023 LINTON CITY COUNCIL REGULAR MEETING MINUTES

The meeting was called to order by Mayor Daniel Imdieke on Tuesday, July 11, 2023 at 5:00 pm. Upon roll call, the following council members were present: James Gartner, Brian Jacob, Randall Meidinger, Wayne Ehley, Travis Dockter, Dennis Morris. Also Present: Attorney Joseph Hanson, Director of Public Works Tyler Gross, Administrator/Auditor Sharon Jangula, Deputy Auditor Joy Bosch.

The Pledge of Allegiance was recited.

A motion to approve the June 12, 2023 Meeting Minutes was made by Wayne Ehley, seconded by James Gartner. Unanimous aye vote; motion carried.

Dan Weber, 125th Celebration Committee Chairperson, updated the council on activities tentatively planned for the Linton’s 125th Celebration being held July 3-7, 2024. He said the committee has been working on the event for approximately 18 months. Dan requested that the City be in charge of parking and garbage pickup for the event.

A public information session and discussion was held on the Street Pole and Street Lamp Project. The project consists of replacing 23 poles in the business district and is estimated to cost $125,000. The project will be funded with funds from the Street Light Fund and Municipal Facilities Fund. Sharon Jangula reported the City of Linton has submitted a Community Facilities application to USDA-Rural Development for $50,000 to help fund the project.

A motion to approve Building Permit Applications: 23-29 Debbie Lindeman-install fence; 23-30 Gunnar & Ashley Hanson-remodel house; 23-31 Zach & Whitney Serr-extend garage & install metal roof; 23-32 Brian Flyberg-remodel garage; 23-33 Randall & Sandra Meidinger-replace shingles and to amend the location of the “new school” on building permit 23-11, Emmons County Historical Society that was approved by the council on May 1,2023 was made by James Gartner, seconded by Brian Jacob. Unanimous aye vote; motion carried.

A motion to approve Gaming Site Authorization for Linton Lions Club at Happy Hour Bar from 7/1/24 to 6/30/25 was made by Wayne Ehley, seconded by Travis Dockter. Unanimous aye vote; motion carried.

A motion to approve the June 2023 Monthly Financial Report was made by James Gartner, seconded by Wayne Ehley. Unanimous aye vote; motion carried.

A motion to approve the Budget to Actual 1/1/23 to 6/30/23 was made by Travis Dockter, seconded by Dennis Morris. Unanimous aye vote; motion carried.

A motion to approve the payment of bills was made by Wayne Ehley, seconded by Brian Jacob. Unanimous aye vote; motion carried. Mayor Imdieke informed the Council that Municipal Judge Jay Schmaltz has resigned from his position effective July 1, 2023. Joe Hanson presented the council with options on replacing the judge or transferring Municipal Court cases to District Court. He explained the pros and cons of each.

After discussion, a motion to enter into a Court Services Contract with the State of North Dakota and Emmons County was made by James Gartner, seconded by Brian Jacob. Unanimous aye vote; motion carried. Hanson will present the agreement to the Emmons County Commission at its August 1, 2023 meeting.

A motion to accept a bid from Roehrich Construction in the amount of $45,780 to remove and replace the sidewalks, steps and ramps around the Linton Community Center was made by James Gartner, seconded by Wayne Ehley. Unanimous aye vote; motion carried.

Tyler Gross presented 3 quotes for a new riding mower. Sayler Implement $17,500 (John Deere); Dakota Performance $14,499 (Bad Boy); Bobcat $14,108.64 (Bobcat). Gross said the John Deere has a rear discharge which is safer to operate as it decreases the chance of objects being thrown from the mower deck. During discussion there was general consensus it is important to support a local business and have the service and parts available locally. After discussion, a motion to Serre accept the quote from Sayler Implement was made by James Gartner, seconded by Dennis Morris. Unanimous aye vote; motion carried. Jangula said the mower will be paid using $8,750 from the Highway Fund and $8,750 from the Asset Replacement Fund.

Jangula reported the 2024 Preliminary Budget must be approved and submitted to the County Auditor by August 10, 2023. There was general consensus to discuss and approve the budget at the August 7th meeting.

Joseph Hanson presented the council with proposed Chapter Six, Public Nuisances of the updated ordinances. The Council will discuss the ordinance at the next meeting.

The next regular meeting will be held on Monday, August 07, 2023 at 5:00 pm.
